WHIMSICAL QUEST – PARTICIPANT AGREEMENT, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK (“THE WANDERER’S OATH”)
 

Before you step into the realm and begin your journey, every adventurer must sign the Wanderer’s Oath. This formal participant agreement and safety waiver ensures a secure, magical experience for everyone taking part in our outdoor escape room adventure. Please review the terms below to authorize your party's registration.

Note: Seekers aged 16 and over may sign independently, while an adult or legal guardian must complete the declaration on behalf of any apprentices under 16."

1. Voluntary Participation and Game Nature
I acknowledge that my participation in Whimsical Quest is entirely voluntary. I understand that the event is a live-action immersion experience taking place in public outdoor spaces, including town high streets, public footpaths, historic courtyards, and local commercial businesses. The game involves walking, navigating public spaces, solving puzzles, and interacting with live actors and other participants.

2. Assumption of Risk
I am fully aware that outdoor physical activities in public spaces involve inherent risks, dangers, and hazards, which no amount of care, caution, or expertise can completely eliminate. These risks include, but are not limited to:

• Pedestrian Hazards: Navigating uneven pavements, stairs, cobblestones, wet surfaces, traffic crossings, and sharing public spaces with vehicles, bicycles, and other members of the public.

• Environmental Factors: Exposure to changing weather conditions (rain, heat, wind, cold), slippery terrain, and natural elements during off-path exploration.

• Physical Exertion: Walking or standing for extended periods across the quest route.

• Third-Party Actions: Interactions with members of the public, other participants, or local business patrons not under the direct control of Whimsical Quest.

I freely accept and fully assume all such risks, dangers, and hazards, and the possibility of personal injury, death, property damage, or loss resulting from my participation.

3. Compliance with Rules, Safety Laws, and Supervision

• Traffic Laws: I agree to strictly obey all local pedestrian laws and highway codes. I will use designated pedestrian crossings and remain fully aware of my surroundings at all times.

• “Slow Gaming” Mandate: I acknowledge that Whimsical Quest is explicitly designated as a "slow game." Running, climbing on historic monuments, trespassing on private property, or disrupting public order is strictly prohibited.

• Age and Supervision: I understand that children aged 14 and under must be actively supervised by an adult (18+) at all times. If I am signing as a supervising adult, I assume full responsibility for the safety and conduct of the minors in my care.

• Expulsion: I acknowledge that Whimsical Quest staff and performers reserve the right to terminate my participation immediately without a refund if I behave in a disruptive, unsafe, or abusive manner.

4. Release of Liability and Indemnification
In consideration of being permitted to participate in the event, I hereby agree for myself, my heirs, executors, administrators, and assigns:

• To Waive Any and All Claims that I have or may have in the future against Whimsical Quest, its parent companies, directors, officers, employees, live performers, independent contractors, volunteers, and the relevant local town councils or municipal authorities (collectively, the "Releasees").

• To Release the Releasees from any and all liability for any loss, damage, injury, or expense that I may suffer, or that my next of kin may suffer, as a result of my participation in the quest due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care.

• To Hold Harmless and Indemnify the Releasees from any and all liability for property damage or personal injury to any third party resulting from my participation in the event.

5. Medical Fitness and Authorization
I confirm that I am in good health and proper physical condition to participate safely in the quest. I confirm that I do not have any pre-existing medical conditions that would be aggravated by outdoor walking. In the event of an accident or medical emergency during the quest, I authorize Whimsical Quest staff or agents to secure medical treatment for me if I am unable to do so, at my own expense.

6. Media, Photography, and Marketing Release
In alignment with the Terms and Conditions, I understand that promotional filming, audio recording, and photography take place during live events. By signing below, I grant Whimsical Quest and its authorized partners the absolute, irrevocable, worldwide, and royalty-free right to use my photographic likeness, video footage, and voice recordings (and those of any minors under my legal guardianship listed below) in any media layout, social media channel, website, or marketing campaign without further notice or compensation.

7. Severability and Governing Law
If any provision of this agreement is found to be unenforceable or invalid under applicable law, that provision shall be severed, and the remainder of this agreement shall continue in full force and effect. This agreement shall be governed by and interpreted in accordance with the laws of England and Wales, and any legal proceedings arising from this agreement shall be brought exclusively in the courts of England and Wales.
